Professional Experience

Mary K. Ephraim is an associate practicing in the areas of bankruptcy law and commercial litigation.  She has practiced in a wide range of areas, including consumer and corporate bankruptcy, asset sales, corporate governance, and regulatory compliance.

 

Shortly after graduating from law school in 2008, Mary Kate commenced a four-year term as law clerk to the Hon. Cecelia G. Morris, the bankruptcy judge who sits in Poughkeepsie, New York.  During that time, she assisted with the design and implementation of the first court-annexed loss mitigation program to address the cases of homeowners looking to the bankruptcy courts for relief during the recent recession.  Additionally, she supported the Judge on matters involving fraudulent transfers, Rule 2004 exams, contested plan confirmations, DIP financing, cramdown of secured claims, and discharge of taxes.  After her term ended in 2012, Mary Kate worked as an associate in the corporate restructuring group at Kramer Levin Naftalis & Frankel LLP, where she prepared a metropolitan hospital for a Chapter 11 reorganization and represented creditor committees in establishing their priority of payment and determining their claims to penalties and interest under complex loan agreements.

 

In 2015, Mary Kate moved on to the national creditors’ rights firm of Weinstein & Riley, P.S., where she defended her clients in FDCPA class action suits, and continued her bankruptcy practice, advising creditors on motions for relief from the automatic stay, proofs of claim, and turnover proceedings.  Additionally, she advised Oak Harbor Capital, LLC, a pioneer in the distressed consumer debt industry, on its compliance program under the Investment Advisers Act of 1940, as well as on state debt buyer licensing regimes applicable to its private equity funds.  In January 2017, Mary Kate transferred to Oak Harbor Capital full-time as an in-house counsel.  She continued to support W&R while handling the general corporate matters of the company, with emphasis on purchases and sales of residential mortgage loans and portfolios of chapter 13 claims, private equity fund formation and dissolution, and the universe of problems presented by nonperforming notes and REO properties.

 

Mary Kate lives in Putnam County and serves on the committee to update the comprehensive plan of Philipstown, New York.  She earned her undergraduate degree from the University of Vermont and her law degree from Pace Law School.  She is admitted to practice in the state courts of New York, Connecticut, and Pennsylvania, and the Southern District of New York (SDNY), Eastern District of New York (EDNY), and the Middle District of Pennsylvania (MDPA).

Appellate Review

We have prevailed in civil and criminal appeals at many levels. Our attorneys are admitted to handle appeals before the New York’s Supreme Court Appellate Division, the New York State Court of Appeals, the 2nd U.S. Circuit Court of Appeals (federal court) and the U.S. Supreme Court.
