Andrea L. Gellen joined SRDD Law in January of 2019 working on the litigation team with a focus on civil, criminal and education law. Prior to joining SRDD Law, Andrea practiced Estate administration and planning, Elder Law and Guardianship, civil rights litigation on behalf of students and employees and Student Driven Litigation (i.e., student discipline, special education, and State and federal litigation on behalf of public school students originating from bullying, discrimination and excessive force), her experience includes:
SPECIAL EDUCATION LAW
Representing disabled students and their parents in Committee on Special Education meetings (CSE or IEP Meetings), 504 meetings, impartial hearings and appeals.
Representing students and their parents in suspension hearings convened under Section 3214 of the Education Law as well as appeals to the Board of Education, the NYS Commissioner of Education, and to state and federal courts.
BULLYING, HARASSMENT AND DISCRIMINATION
Litigation in state and federal courts stemming from school districts’ failure to address or prevent bullying, harassment and/or discrimination against children, including Dignity for All Students Act and negligent supervision matters, Title IX and Title VI cases, and excessive force/1983 due process claims.
Applications for appointment of guardians for incapacitated and developmentally disabled individuals under Article 81 of the Mental Hygiene Law and Article 17-A of the Surrogate’s Court Procedure Act. Assist guardians with all aspects of the management of guardianship estates.
Development of plans for possible incapacity, or need for nursing home care, including preparation of Powers of Attorney, Health Care Proxies, Living Wills and Medicaid Trusts. Applications for appointment of guardians for the incapacitated and developmentally disabled under Article 81 of the Mental Hygiene Law and Article 17A of the Surrogate’s Court Procedure Act.
Development of estate plans for individuals and the preparation of estate planning documents, including wills, revocable and irrevocable trusts. supplemental needs trusts, life insurance trusts, generation skipping trusts and charitable trusts. Creation of estate and gift tax plans to reduce or avoid taxation. Assist business owners to plan for the transfer of businesses to a younger generation.
SRDD Law will handle pre-trial procedures including interlocutory hearings, and the port-trial procedures such as costs and enforcement of a judgment for individuals and businesses.
