The new New York no-fault divorce law, signed into law by Governor David Paterson on August 15th, 2010, gives New York residents the opportunity to file for divorce without the often long, drawn out court battles over who was at fault.

The new no-fault divorce law is expected to greatly reduce the emotional and financial cost of having to find fault with one of the parties in order to obtain a divorce. New York was the last state in the nation to pass a no-fault divorce law that affects child custody arrangements, property division and spousal support.

Under the New York new divorce and alimony laws, either spouse may file for divorce, without needing to claim fault on the part of the other party. In the past, the filing party was often forced to make up ‘grounds’ for the divorce, even if irreconcilable differences was the only real reason. The new no-fault divorce law will greatly impact how divorces are handled in New York. It is expected to greatly reduce the emotional and financial cost of having to find fault with one of the parties in order to obtain a divorce.
